Asimov would tell you that a modern LLM would try to skirt the rules exactly the same way, regardless of whether it had ever seen the Three Laws or not.
It is a machine that optimizes profit and absolutely nothing else. It does not and cannot consider what is "good" or "right" or even "legal" unless and until one of those things directly and indisputably hurts profits too much.
This is magical thinking. "The market" is fundamentally incapable of making things better for you, the consumer.
Since you won't go through forced arbitration and the arbiter will always agree with the company, they are not exposed to your petty legal action and are free to do whatever the hell they want, regardless of whether it's legal.
This is no different from a CB radio where you can lift the cover and tweak some adjustments for higher (read: illegal) TX power. This is a normal, expected development feature which requires extraordinary effort for users to find and abuse. Espressif is almost certainly in the clear
You cannot be tried multiple times for the same instance of a crime.
Since OAI et al don't appear interested in stopping crime, they can (and likely will) be tried again the next time they do it.
If an LLM makes shit up, your one and only recourse is "computer says no".
Our system works on the principle of preventing the "wrong" people from voting. And "wrong" here means poor and Black people who often have difficulty producing the required documentation and paying the fees for same.
There's no such thing as a free lunch.
