literallyaduck··on Court Upholds “Geofence” Warrant for Information on Phones Near a Crime
Searches require warrants. The fourth has specific criteria, requiring specific location and people or items.

A geofence fails that criteria because it doesn't say who is to be searched, it also has an overly broad place.

An address explicitly listing buildings is half of appropriate criteria, a city block is not. A 2 mile radius is not.

The other half is the specific people or items.

literallyaduck··on Court Upholds “Geofence” Warrant for Information on Phones Near a Crime
A log of my whereabouts and activies I consider my personal document, exactly the same as I consider a paper version stored in a briefcase. I took the false example from the article and adapted it rather than just using the headline.

"Imagine a homicide in an alley caught on a nearby surveillance camera. The video is clear enough to see the attack, but too grainy to identify who did it. It is obvious from the video, however, that the perpetrator is checking his cell phone as he walks out of the alley. Having determined the location and time of the killing from the video, would it be lawful for the police to obtain a warrant leveraging the tracking capability of mobile devices to identify whose cell phone was in the area of the crime when it occurred?"

In this case I swapped a digital briefcase for a physical one. If I hire someone to carry my briefcase it does not negate my right to the protection of it or its contents.

literallyaduck··on Facebook said my article was false – now the fact-checkers admit they were wrong
It would be nice if a case was brought for libel and all Facebook and the fact checker communication was subpoenaed to show a clear instruction and bias to mislead. Without paying a price they will continue to gas light, lie, influence elections with funding from foreign powers.
literallyaduck··on Court Upholds “Geofence” Warrant for Information on Phones Near a Crime
A dissent using a slightly altered scenario, you see a killing on a security cam, and the killer puts a knife in their briefcase on camera then you have the police stop everyone in a 2 mile radius and break into their briefcase rifle through their documents and arrest people based on the findings, you might catch the killer but you have trampled the rights of everyone in the zone. The density of the zone shouldn't matter, if it is on Wallstreet or a field in Kansas it is equally wrong. A range is not a particular place and they didn't identify the people as stated:

"[t]he right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

It clearly says "AND". They don't know who or what they are targeting and the 4th clearly protects that.

Waffle Street movie is a must watch for this situation. I won't spoil it but these large corporation announcements sound like an equality empathy booster and make for good PR.
literallyaduck··on DoE spent $1.1B to build carbon capture demos
Claw it back and refund the taxpayers. Bipolar red and blue government wastes everyone's time and money with policy oscillation. Instead of pulling the cart back and forth let's find a peaceful, democratic legal separation of the ideological incompatible.
literallyaduck··on New York City to require employers to list minimum and maximum salaries
All positions are now unique use a guid designation and have the same minimum as maximum are immutable. To change salary the position will be retired and a new one will take its place.

You know, for grain storage, and for the ancient aliens to communicate through crystal power, or a flooded Bass Pro shop.
literallyaduck··on UberEats took unauthorized amount (and not willing to pay it back)
Go get a poster board and stand in front of the restaurant "Uber Eats stole my money."

Contact Google or Apple and tell them their App is fraudulent.

Contact the police about the theft, non emergency line.

Charge back from your bank.

File a complaint with the town chamber of commerce.

Contact your state's attorney general office.

Contact your town's newspaper and tv.

Remember that pounds are not US currency and the advice doesn't apply.

literallyaduck··on India defuses its population bomb: fertility falls to two children per woman
Here is what I've heard argued from that ideological standpoint.

One off famines should be remedied with relief efforts which mandate the recipient country increase its food storage to be able to absorb the next one.

Chronic food shortages are a symptoms of overpopulation of the area, either because of lack of farming technology, terrain, etc. Supplying food aid only compounds the problem by increasing an unsustainable population. The remedy is to remove the mismanagement and relocate, and reducate the willing population and let nature take its course for those unwilling to adapt.

Sounds harsh but a famine of 1 million people being supplied with aid turns to 1.2 million the next time and 2 million the time after. A net increase in misery and suffering.

In reality faced with a starving person face to face, I believe most people would feed the hungry.

literallyaduck··on What’s the jankiest piece of tech you’ve seen a company depend on?
Microsoft Access.
literallyaduck··on Ask HN: I've lost faith in myself as a developer, how do I get it back?
Technical Managers move to Non-technical over time.

Here is another secret, no one has the right way to develop. There are many development styles and some produce better short term or long term results.

Unelegant code that works might be just the thing until more robust, better architected, unit tested code takes its place it all comes down to the purpose. A small one off hacked together solution for on boarding might be better than spending three months to "get it right " it all depends on risk appetite, project standards, and the scenario.

Don't act like you know better if you don't. Listen to other developers ideas, they might have input you haven't thought of.

Always Be Learning, not as catchy as always be closing, but the path of a developer is a path not a destination. You can always make progress.

Fear of failure or being called out as a fraud shouldn't stop you. Remember everyone makes mistakes, no one is perfect, lots developers think they write the best code in their shop, and would critique your code even if you objectively were the best developer of all time.

Learn the industry standards as you can and shore up your weaknesses with good underlings that will help you learn.

literallyaduck··on Kentucky candle factory bosses threatened to fire workers who fled tornado
Unless they physically prevented them from leaving it was still their choice, and it comes down to the individual's choice. I've walked out of situation which I deemed risky not knowing if there would be another job available, because I thought the risk was too great, I've also seen people who ignored the danger get seriously hurt.

Managers who don't put people's lives above profit make the same risk assessment but with other people's fathers, mothers, sisters, and brothers and will have to live with that choice. Company culture also has a lot to do with management pressuring people to live dangerously.

Wow the Alphabet works fast.
literallyaduck··on Ask HN: If money were not an issue, would you be a solo indie game developer?
You are absolutely right about crypto and gambling, I was thinking more about legacy banking, mortgages, that sort of thing. Gambling is inherently a form of gaming.
literallyaduck··on Ask HN: Why is everyone so fake on LinkedIn?
Same reason corporate music is bad, it can't have anything meaningful or it wouldn't be work friendly. The message is I'm employable, I signal the current corporate virtues, looks at what all I'm learning, wow Jim it has really been ten years at Saber, wow the years have flown.

Say the wrong thing, canceled, not only from future employment but current.

There is nothing genuine about a corporate business lunch and this is just another location.

literallyaduck··on Ask HN: If money were not an issue, would you be a solo indie game developer?
Yes. Games are fairly universally loved, no one really wants to make accounting software or telecom middleware or fintech apps, they ultimately build them for money. If money was covered then reaching the self actualization phase of life is possible and who wouldn't want to make their own game?
literallyaduck··on Code to flood Kellogg with bogus job applications after strikers sacked
How many Code of Conducts have been added to repository since people have been asking for them?

The collective bargaining I was suggesting was to talk with your own companies which have a business relationship to Kellog.

Work in a hotel that has minicereal boxes? Get with purchasing to stock a different brand. Work in a grocery? Ask the owners to stock a different brand on a public forum.

See Kellogg flakes at a friend's or family's house? Ask them politely not to support union busting.

Daily call one local business until they agree not to stock Kelloggs.

literallyaduck··on Code to flood Kellogg with bogus job applications after strikers sacked
Just stop using their products and don't hire anyone who started working there after the labor dispute happened. Get big companies to sign a pledge like a code of conduct that says they won't do business with scabs or companies using scabs. Use collective bargaining to hold their feet to the fire.
literallyaduck··on Ken Jennings and Mayim Bialik to Share ‘Jeopardy ’ Hosting Duties
They should pull a George Lucas and make a CGI host. AI generated characters are getting better, they never have to pay them, they never say cancelable speech, they can be retroactively replaced, they can be regionally replaced.

It would add buzz to an ordinarily flat segment of television.

literallyaduck··on Defund the Police meets the crime wave
Threatening to defund the police generally lowers the quality of your existing police. Pretend you run a business and say you are cutting salaries. Employees will look for other jobs or just be demotivated in general. Couple that with an increasing hostile work environment, you have the situation at hand.

Do you work as hard when you know management is gunning for your job?

literallyaduck··on Lead contamination in hunted meat
This is the insidious thing about lead, those consumers who have been exposed now may be unequipped to rationally evaluate the problem, the risk, the severity and alternatives because of their diminished mental state.

Victims of lead based mental illness have the same vote weight that you do.
