jakewalker··on Google’s copying of the Java SE API was fair use [pdf]
He addresses this in footnote 1 on the same page, though. "A different company, Sun, created the library. But because Oracle later purchased Sun, for simplicity I refer to both companies as Oracle."
jakewalker··on Cloud Storage for $2 per TB per month
Sounds kinda like the people who thought that bundling a bunch of bad mortgage debt together in slices could get it rated AAA.
jakewalker··on Yahoo Customer Data Security Breach Litigation Settlement
Plaintiffs' class action (mostly securities) lawyer here. I have no idea what you are talking about.
jakewalker··on Trump orders U.S. firms out of China after Beijing sets new tariffs
Not unilaterally, without any process.
jakewalker··on Trump orders U.S. firms out of China after Beijing sets new tariffs
He does not. Which doesn't make the headline inaccurate. But he does not have that authority, and no one right-thinking believes that he does.
jakewalker··on Trump orders U.S. firms out of China after Beijing sets new tariffs
Absolutely not. It's not remotely a thing, and would not withstand any scrutiny whatsoever.
jakewalker··on Starbucks, monetary superpower
That may be part of it, but Starbucks has done a very good job of getting their regular customers to sign up for their loyalty program and online/app ordering, and to have them sign up for automatically replenishing (every time my balance goes below $10, load another $25) gift card accounts to use both features.
jakewalker··on Google Forcing Nest Cameras’ Visual Indicator Light To Be On
We use Nest cams for a baby/child monitor at nighttime. Haven’t seen the change yet, but I suspect it will make it so that this use case no longer works.
jakewalker··on How transportation can transform a city – Seattle's double decker tunnel
The Big Dig in Boston was full of the same overruns, delays, and even corruption. All worth it.

It's the best thing the city has ever done, far and away. Fundamentally changed the city and is responsible for incalculable property value and quality of life improvements in the city.

No it isn't.

jakewalker··on Amazon Key is a new service that lets couriers unlock your front door
And there are multiple inaccuracies in all of these replies.
jakewalker··on Coda, a “next-generation spreadsheet” – from rows and columns to custom apps
Lotus Improv was one of the best programs I've ever used, and I wish it would come back in a modern form. It was much more sophisticated than just having "names" instead of row/column coordinates. It had an easier to use and in some ways more powerful version of PivotTables. Man, I miss Improv.
jakewalker··on Judge: There’s no proof Yelp manipulates reviews
The standards for adequately pleading a securities fraud lawsuit -- which this was -- are incredibly high, and the plaintiff has to meet that standard without access to any discovery from the Defendant (here, Yelp). Which is all a way of saying that it is extremely difficult to read too much into the dismissal of a securities fraud lawsuit.

The judge in this case was basically concluding that plaintiff -- a Yelp investor -- could not adequately allege in his complaint that Yelp or its executives made a false statement of material fact in connection with the sale of a security. And plaintiff had an extremely high burden to survive such a motion to dismiss because of the Private Securities Litigation Reform Act (https://en.wikipedia.org/wiki/Private_Securities_Litigation_...).

So, in short, there is very little that one can conclude about Yelp's actual practices (for better or for worse) from learning that a securities lawsuit like this was dismissed.

jakewalker··on Class action lawsuit filed against Lenovo over Superfish
There were a number of lawsuits that were filed against Lenovo as a result of Superfish. I believe the Joint Panel For Multidistrict Litigation will soon (May 28) hear argument about whether and where those cases should be consolidated for pre-trial matters. jakewalker··on U.S. NSA domestic phone spying program illegal: appeals court
There is a doctrine called "constitutional avoidance" - if a court can decide a case on grounds without reaching a constitutional question (particularly a close question), it ought to decide the case on the alternative grounds and avoid the constitutional question.

So, for example, a court might say: This action was improper because it was not authorized by Congress. That is all we need to decide. Because we made this decision, we don't need to reach the constitutional question. Of course, if Congress had authorized this action (or now does so), and this case is back before us, we will no longer be able to take that path. We may, at that time, decide that the congressionally-authorized action is unconstitutional. But because there is no need to do reach that decision at this time, we decline to do so.

jakewalker··on The Slave Ship That Ran from Kerala to New Orleans
Thanks. We represent the plaintiffs on a pro bono basis. Actually, almost a dozen law firms are donating their time to these cases (after class certification was denied, the workers were required to bring their lawsuits individually). It is tremendously rewarding work, and for me a great opportunity to take on responsibility I might not otherwise get at this stage of my career.
jakewalker··on The Slave Ship That Ran from Kerala to New Orleans
I have had the great pleasure of helping represent a group of these workers (not the folks who just recently went to trial, but another related case in the Eastern District of Louisiana). One of the most gratifying experiences I've had as an attorney. Really glad to see this story getting attention here.

If you are interested in the topic, I'd highly recommend taking a look at some of the SPLC's work on the issues surrounding the H2B program generally: http://www.splcenter.org/get-informed/publications/close-to-...

jakewalker··on Don't upgrade to iOS 8.0.1 or you may experience “no service”
I had this issue and was able to fix it:

I did an OTA update (iPhone 6, AT&T) and experienced this issue. Touch ID wasn't working and "No Service" on the phone. I tried hard resets and resetting the SIM card, with no success.

I was able to fix the issue by downloading the iOS 8.0.1 ipsw from the developer site, then connecting the phone to iTunes, holding down option while clicking on update, and selecting the 8.0.1 ipsw. Phone redid update through iTunes (not OTA) and when it restarted, all was fixed.

Not sure how non-developers can get the .ipsw file.

Not sure how I would explain how to do this to, say, my mother. Hopefully there is a more sensible/easy fix that comes out soon.

jakewalker··on Don't upgrade to iOS 8.0.1 or you may experience “no service”
Neither is working. Some speculation that it is an OTA issue. AT&T rep told me to try to redo update through iTunes. Requires downloading the .ipsw. I'm giving that a try now. Hopefully they will have a more sensible fix out soon.
jakewalker··on Adam Carolla won’t let Personal Audio drop podcast patent infringement lawsuit
Depends on whether or not there is a Confidentiality/Protective Order in place, and if so, what the terms of such an Order say. Almost every case of this nature would be subject to some sort of Confidentiality/Protective Order. Generally, the parties would be able to designate documents, deposition testimony, etc., as Confidential. Sometimes there are multiple levels of confidentiality baked into one of these orders (for example, a "HIGHLY CONFIDENTIAL" designation might mean that only outside counsel can review a produced document).

Generally, documents marked as such must be filed under seal, cannot be disclosed publicly, etc.

jakewalker··on Stellar
Not a great sign up experience - I signed up and linked my Facebook account. Then, I went to click on the link to confirm my e-mail address (from the confirmation e-mail) and got logged out. Now, my login isn't working, nor is password recovery. Impossible to figure out whether I mistyped my username or there is some other issue, and no "Forgot My Username"-type feature to be able to make sure.
jakewalker··on 3rd Circuit vacates Weev's conviction [pdf]
The opinion came out very recently (within the past hour), so there is not likely a good summary or analysis available yet. Seems reasonable for OP to want to spread the news without waiting for a news story.
jakewalker··on Amazon to Raise Fees as Revenue Disappoints
Prime! (Albiet for low priced, but not add-on, items - in the range of $12-$18).
jakewalker··on Amazon to Raise Fees as Revenue Disappoints
Lately, my Prime deliveries have been sent via UPS Mail Innovations, which relies on the USPS for last mile delivery. This inevitably turns 2-day delivery into 1 week plus delivery, due to the USPS's incompetence where I live. Complaints to Amazon result in a free one month extension of Prime benefits, but they can't stop the service from being chosen on future orders.

Unless this changes soon, I am likely to let my Prime membership expire, as it has become useless to me because it is no longer reliable. Any attempt to raise the fee while still using USPS for last mile delivery will be met absolutely with cancellation.

That said, if they raised the fee and promised to use only reliable (e.g., UPS, FedEx, hell, even Lasership/OnTrac), I'd take the deal.
