That's a major source of the danger. If they were being consistently and equally enforced, then it would be obvious when there were issues. In the case with selective enforcement, the government can point to the law and say they're in the right, but only apply it when it suits them. This lets the people making the rules and the people who are in their good graces do what they'd like due to selective enforcement and not face the consequences of their actions.
IANAL but, I suspect that since the full length jail sentence is considered neither cruel nor unusual and is an option for the convicted person, that should mean that if they choose a different option, it can't be cruel because they found that option more pleasant than one that is already determined to not be cruel. I guess this assumes that people will tend to choose the less cruel punishment given two options, but that seems like a safe assumption.
I've since been corrected... Seems I didn't read closely enough.
1. Last time I heard pricing per pound to orbit was ~$10,000 per pound. This was for the shuttle though, so I don't know if this has changed. 2. I would guess this depends on the launch provider. Whoever's launch you're piggybacking off of will probably get to make this decision. I never heard of any real restrictions, but this wasn't my area of expertise. 3. You'd be right about that. I don't know about pricing, but your payload will need to go through vibration testing and the like 4. No clue on this one 5. You'd probably have to physically make the trip (and I'd think you'd want to. Seeing a launch is always cool). Timing will depend on whose launch you're piggy backing off of, but we needed to have everything done a few weeks before launch day.

Anyone know the significance of the time? Or is it just trying to be more effective than saying an hour? (In the same vein as parking lots that have speed limits of 4 mph rather than 5 mph so that motorists are more likely to actually watch their speed because it's different)
