rights_reminder··on The time bomb in the tax code that's fueling mass tech layoffs
If anyone cares about combatting government propaganda in the US, do this:

Query any search engine for "are US income taxes direct or indirect taxes"

Every one will tell you that they are direct taxes. This is false. The supreme court has exclusively held that income taxes have always been indirect taxes (excises specifically, read about what an excise is in any authoritative source on tax law) in a constitutional sense. (See Brushaber v Union Pacific RR Co. 1916, Moore v U.S. 2024)

The sixteenth amendment did not give congress the power to directly tax citizens (or domestic corporations) and the complexity of the tax code is an attempt to obfuscate this fact, but the code is not inscrutable, it has rules.

Unsure of why this matters? Look up the difference between direct and indirect taxes in US law. None of these deductions matter unless you are a foreign corporation. I have tried commenting about this in other income tax related threads (this is my alt account), but people here don't like the idea that there is government propaganda in the US, or that most people are wrong and blindly accept the socialization about taxation without verifying what the law says.

I realize this is a disturbing truth to accept, not least because it involves accepting that most people who have been prosecuted for income tax crimes are only guilty of ignorance of the true legal purpose of the forms they signed. You can easily verify that most accountants and tax attorneys do not know what they are talking about by asking them this simple question about direct vs indirect taxation.

This is not legal advice, it is a wakeup call.

99% of Americans are not supposed to be filing a tax return. Unless you paid US source income to it's foreign owner, you should not be either. What gave you the idea that you needed to?

The point of my comment was that, in the US, the government has to create an elaborate body of law to trick people into thinking the law says something which it does not say. If we did not have limitations on the taxing power of congress, they could just write a simple law that says "There is hereby imposed on all labor of every person working in the 50 states a tax equal to..."

The fact that there is no such sentence in US tax law should be a wake-up call... The reason the income tax parts of the IRC are so complex is to keep them in perfect accordance with the constitutional limits on taxation while deceiving you. Taxes on income are in their nature excises, which are taxes on privileges. Foreign persons do not have the same rights that we Americans do (I don't necessarily agree with this, it is just how the law works).

Eventually this will come to an end. Tens or hundreds of thousands of people have known about what I am saying for a hundred years. Eventually a critical mass of people will be wise to the scam and HR departments will no longer subordinate perjury by pressuring clueless people to improperly sign a Form W-4, declaring themselves to be a foreign person subject to wage withholding (see Treasury Decision 8734)[0].

I know these cuts make almost no difference to the massive federal spending, but they are putting a spotlight on our nation's dire financial situation.

Most young people have no hope of owning a home or having kids and our federal government is "borrowing" money to pay for all of these things. Last year it added 1830 billion dollars to the national debt while paying 1126 billion in interest. Take a look at the dollar price of gold chart if you haven't recently. This is obviously not sustainable, maybe even in the short term.

To continue steal from our children's futures to pay for decades of accumulated corruption, appropriated by Congress, is a crime. Can anyone see a reasonable path forward where we don't make drastic changes?

I will bring this up every time someone mentions this, but your money is not being taken without consent. You are signing tax forms without knowing what they mean in law and voluntarily (incorrectly) giving it to them. Income taxes are excise taxes.
rights_reminder··on Who exactly needs to get approval from an institutional review board (IRB)?
The point that I was making was that there can be no federal law which requires an institutional review board for private research, which was something the author alluded to in the paragraph after the flow chart:

> The government can’t possibly claim to regulate what me and my roommates eat at home! That would be stupid!” Yes, it would be stupid. But who says the world makes sense? Now, would you actually be prosecuted for violating those rules?

Author says "those rules" without actually citing anything.

There is no scenario in which the Secretary of HHS can create rules which would do what the author was suggesting. It is not even something Congress could do, which is why they haven't created a statute which goes beyond their authority in requiring these boards for anything other than research receiving federal funding. If the Secretary were to create such a rule, it would obviously exceed his authority.

It's hard to take the article seriously since

  1) It doesn't even reference the relevant law
  2) The relevant law is so simple and clear
42 USC 289(a) states:

"The Secretary shall by regulation require that each entity which applies for a grant, contract, or cooperative agreement under this chapter for any project or program which involves the conduct of biomedical or behavioral research involving human subjects submit in or with its application for such grant, contract, or cooperative agreement assurances satisfactory to the Secretary that it has established (in accordance with regulations which the Secretary shall prescribe) a board (to be known as an “Institutional Review Board”) to review biomedical and behavioral research involving human subjects conducted at or supported by such entity in order to protect the rights of the human subjects of such research."[1]

To put it succinctly this only relates to any entity which applies for a grant, contract, coop. agreement under chapter 6A of 42 USC.

This in no way relates to private research. It's easy to get hung up on regulation spaghetti code, but regulations cannot exceed the scope of the statutes, which in turn cannot exceed the authority of Congress.

Chances are your CPA was not correct. CPAs routinely violate the law as a regular course of duty and the IRS is fine with it, even encourages it, because it gives them more revenue. If you are looking to go down a multi-year rabbit hole on this, then try to find the law that imposes any tax on __your__ domestic income.

(Hint* You can't)
