It certainly is a lot more ambiguous than absolute free speech, yes. I think your example would still count as hate speech inciting violence against black people. The Nazi one I'm not sure off the top of my head, to be honest.
malermeister··on Starlink Defies Order to Block X in Brazil
You are free to express your opinions ("I don't like immigrants from Africa"), but you are not free to choose any manner of speech, as there's restrictions in certain areas, such as hate speech or inciting violence ("Kill the N-words!")

It removes the censor that is Musk.
malermeister··on Starlink Defies Order to Block X in Brazil
That's why the conversation in Europe is usually about Freedom of Expression, not Speech.
malermeister··on Starlink Defies Order to Block X in Brazil
Because he's a huge hypocrite and only uses the excuse of free speech to enable right wing radicals, while not granting it to anyone he disagrees with.
malermeister··on Starlink Defies Order to Block X in Brazil
Was it free speech when he banned a bunch of leftists for disagreeing with his views?
malermeister··on Starlink Defies Order to Block X in Brazil
Marx was right and people like Musk and Thiel are living proof.

Yup, it's the reason we shouldn't be shooting up Satellites for frivolous reasons like internet in the first place.

malermeister··on Sonos CEO says the old app can't be rereleased
Oh nice, I'm already using HA and embedding LMS in an iframe. Might be worth a look. Have you used both? If so, how do they compare?
malermeister··on Sonos CEO says the old app can't be rereleased
1) Put LMS (https://lyrion.org/) on your home server/a raspberry pi.

2) Get a bunch of raspberry pi zeros with a hifi hat.

3) Put picoreplayer (https://www.picoreplayer.org/) on them.

4) Use the material skin (https://github.com/CDrummond/lms-material) so it doesn't look like 1995.

Congrats, you now have your own, fully open source, sonos equivalent for multi-room synced audio. Supports all major streaming platforms as well as a local library.

malermeister··on Apple found in breach of EU competition rules
Open markets != unregulated markets.
malermeister··on Apple found in breach of EU competition rules
Sure. But every institution is elected one way or another.
malermeister··on Apple found in breach of EU competition rules
We vote for the parliament, which was only like a week ago. Each country also votes for their government, at times specified by their constitutions. Those governments then form the Commission and the Council.
malermeister··on Apple found in breach of EU competition rules
It's not about what Apple users want. It's about what the law requires.
malermeister··on Apple found in breach of EU competition rules
The core raison d'etre for the EU is open markets. They'll do a lot to keep their fundamental core principle.
malermeister··on Commission opens additional DMA investigation against Apple
This is a fundamental misunderstanding which keeps causing trouble for US companies:

In European law, the letter of the law doesn't matter. The intent does.

It's called teleological interpretation, here's an EU document with a bit more background: https://www.europarl.europa.eu/RegData/etudes/BRIE/2017/5993...

Key quote:

> When interpreting EU law, the CJEU pays particular attention to the aim and purpose of EU law (teleological interpretation), rather than focusing exclusively on the wording of the provisions (linguistic interpretation). This is explained by numerous factors, in particular the open-ended and policy-oriented rules of the EU Treaties, as well as by EU legal multilingualism. Under the latter principle, all EU law is equally authentic in all language versions. Hence, the Court cannot rely on the wording of a single version, as a national court can, in order to give an interpretation of the legal provision under consideration. Therefore, in order to decode the meaning of a legal rule, the Court analyses it especially in the light of its purpose (teleological interpretation) as well as its context (systemic interpretation).

Facebook, too, tried rules-lawyering EU regulations only to be slapped with a huge fine. This shit doesn't fly here.

malermeister··on EU says Apple has serious issues for not complying with DMA
This article does a good job talking about this: https://www.baldurbjarnason.com/2024/facing-reality-in-the-e...
malermeister··on EU says Apple has serious issues for not complying with DMA
Trillion dollar companies shouldn't exist in the first place. At that point, they are entities way too powerful to be in private, undemocratic hands.
malermeister··on EU says Apple has serious issues for not complying with DMA
I hope they make an example out of them. One can't even call their behavior "malicious compliance", "malicious noncompliance" is more fitting.

malermeister··on EU Council to Vote on Chat Scanning Proposal on Thursday
> There is not gradient. If society is socialist then as per definition and as explained there must be authoritarianism to suppress any private initiative.

This logic works both ways. There is authoritarianism to enforce private ownership in capitalism. The police is a tool of the capitalist class, designed to suppress any protest against the capitalist system. It even extends internationally, to Imperialism. One only needs to think of banana republics, or more recently, Coca Cola murdering union leaders.

malermeister··on EU Council to Vote on Chat Scanning Proposal on Thursday
Of course it is. By voluntary association into socialist communes. https://en.wikipedia.org/wiki/Libertarian_socialism
