Discover happens before a trial, and so far as I can tell, only a complaint has been filed. From there, OpenAI can respond, both sides can move for a summary judgement, or failing that, start the discovery process.
And if OpenAI cannot get it dismissed, they'll probably just settle, which then stops discovery. (IANAL)

Same here. But "all the evidences" is a very vague statement, even in simple cases. AFAIK defendants need to make a good faith effort or reasonable judgement about what's relevant and what's not, and the other side can object that effort.
