They're not being fined for the percentage they take are they? Rather it seems they are being fined for banning app makers from letting users buy subscriptions outside the app store.
Arguably Apple could still create licensing terms that take a percentage of revenue that happens outside the app store. The only odd bit about Apple is they're structured it around a transaction fee on the App Store rather than royalties for IP, which is more traditional. If they asked for royalties for the use of Apple SDKs, Apple branding, etc. instead, then it looks just like just another commercial vendor.
