And most cases as far as I understand revolve around the users not actually paying attention as they should.
I agree that the system is marketed wrong. It should be called a copilot which implies the dual control responsibilities. Unfortunately that will never happen now as Microsoft has bet their whole company on this trademark :) :)
I think there's certainly a place for AI though. But for driving it's not there yet, at least to be in full control.
