The funny thing is though that there is a strong conservative argument to be made against the sweeping power of SCOTUS. Out of all the federal branches, they--being unelected--are the least accountable to the public and the decisions they make cannot be appealed or nullified except by their own subsequent decisions. SCOTUS serves as a sort-of "final grand council of elders" that can nullify or change any aspect of the law with no oversight or recourse.
I'm no fan of Congress but at least they are directly accountable to voters. If there is a conflict among the three branches, it should be Congress that prevails not SCOTUS.
