For anyone unaware, one of the main criticisms of that ruling is that the president commanding the military is always considered an official act, and this ruling means the president enjoys "absolute immunity for official acts within an exclusive presidential authority that Congress cannot regulate such as the pardon, command of the military, execution of laws, or control of the executive branch."[0]
The ruling made no carveouts or exceptions for blatantly illegal orders. The president could unilaterally eject or kill any member of opposing political parties and future administrations (if there are any) would be completely unable to legally hold them accountable for their heinous crimes.
And before you say "that's indirect!", it genuinely does not matter how indirect the execution is or how many "translation layers" there are. Python for example goes through at least 3 translation layers, raw .py -> Python bytecode -> bytecode interpreter -> machine code. Adding one more automated translation layer does not suddenly make it "not code."
And no, the severity of the crime does not (IMHO) justify it.
If you finetune a model and it starts misbehaving, what are you going to do to it exactly? PIP it? Fire it? Of course not. AIs cannot be managed the same ways as humans (and I would argue that's for the best). Best you can do is try using a different model, but you have no guarantee that whatever issue your model has is actually solved in the new one.
Personally, I'm not buying the slippery slope argument. I could be wrong of course but that's the great thing about opinions: you're allowed to be wrong :)
If these companies aren't willing to put basic measures in place to stop even the most obviously illegal ads from airing, I have a lot of trouble having sympathy for them getting their just desserts in court.
