The questions accepting both the correct answer and the slighly incorrect answer I can understand. The "rule of law"-question, however, seemed more serious. I really wonder how things like that come to be.

Not only that, but its not intended to be answered by lawyers either. For a bar exam that question wouldn't be a good one, for a test to see if someone grasps the general concepts of how America works, it seems perfectly reasonable.
