I don't see why it matters to the argument if the original creator is alive.
I also don't believe the creator has a special obligation to make things available. But I generally agree with the GP, once something is released and widely popular, society now shares some ownership. There should be some way to access it, at least as part of the historical record.
It's not the creator's responsibility to facilitate that, but they also shouldn't be able to hinder it.
