You can't assume things will return to the previous normal while the Supreme Court maintains its current composition either.

Which is why Democrats need to alter that composition once they retake power.

The conservative majority Supreme court will rule it unconstitutional. Then what?

The size of the court is set by statute. It would be pretty wild, even for this batshit court, to find a law increasing its size to be unconstitutional.
