I'd like to point out that this accusation isn't about encryption or personal privacy per se, since this same kind of accusation could occur if a company executive finds out someone is suing and then "accidentally" trips and throws hundreds of pages of non-personal documents into an industrial shredder.
I am kinda surprised they went for an consumer grade off the shelf software.
