You'd probably also have to disable the cellular modem. If Apple are "smart" about this, they'll use location from cell towers.
In other words, the court said normal people turning on "private browsing" expected what they were browsing was private.
In a similar fashion, maybe people turning off "location services" would expect their location to be hidden.
