Is Tesla open source? Roadster certainly isn't

Well Tesla Roadster is about as opensource as other OEM manufacturers. Difference is that they are not calling it open sourcing their cars, but maintenance information.

since the software conservancy enforces gpl compliance, this article sounds like they will sue.

They have never claimed to be releasing it under GPL license though.

The article says they used the GPL linux kernel, modified it and distributed binaries without providing the sources. This is a GPL violation.

I don't know if they can sue on behalf of the copyright holders of the kernel, that might be another question.

The article also falsely claims that Tesla software is faulty and killing people. Which is not what the software update recall was about.

The recall was an over the air update that increased the nag frequency of the lane keeping assist. Of note other brands such as Kia have no nags or warnings while lane keeping is on but no action has been taken to initiate a recall.

I have a 2021 Hyundai (same manufacturer as Kia) and it definitely has a nag for lane keeping.
