GitHub will defend you, if accused of copyright infringement due to Copilot

Doubt they will help you if you caused your company to use a patented code for profit.. At best you'll loose your job, at worse, you'll get sued by both your company and the actual third-party

You are responsible of your own action, it's similar when you buy stolen goods from facebook marketplace, you should always ask for a receipt or proof of ownership, for code it's similar, you ask what's the license, and you include the license in your source tree if you are allowed to use the code ;)
