On what grounds? This sounds like a problem with the legal system, not medical transparency. Though I can empathize with medical professionals having to work in the legal system that we have, not a hypothetical perfect one, I'm very apprehensive of restricting transparency on the grounds that, if people saw what was going on, they may take legal action.
