It could be chaos if ignorant courts find that contributors to open source projects can be forced to alter code to meet imaginary fiduciary duties, or open them to lawsuits that can ruin them.

Yeah, but he's asserting legal partnership formation occurs when people are engaged in a common enterprise, which is essentially applying the standard of conspiracy to corporate formation. The fact that he's parallel litigating the case on twitter at the same time as in court makes him look pretty cranky.
