Which precedent? The one where the 14th Amendment forbids racial discrimination, or the narrow carve out 20 years ago that has allowed it to continue in higher education?
I don't think they are incompatible and I don't think the people who voted for the 14th Amendment would think so either.
How do you feel about the fact that it effectively discriminates against Asians?
(And do you think it is relevant to mention the previous discrimination against Jews, decades ago?)
