It looks good for Musk owning twitter. He's annoyed the chancellor multiple times, and probably lost her respect. And now he has to pivot his case to Mudge, while sticking to the original, already very tight court schedule. It's going to be rough on $TSLA if he still has to sell $30B into this economy.
Yes, Musk won the point of including the Mudge disclosures, but he has to prove them with little to no discovery on a breakneck timeline. That's a hand tied behind his back. I see this as a win for Twitter overall.
I really hope Musk is forced to buy Twitter. I don’t actually disagree with his claim that there are way more bots than Twitter claims, but the guy willingly waived his right to due diligence and should be forced to follow through.
It’s not like he’s a naive first time investor. He’s one of the worlds richest people with a team of lawyers and advisors. He didn’t waive his right to due diligence by accident.
If I buy a truck from a dealership sight unseen and then arrive at the dealership and find out that they've lied and it doesn't have an engine, or has a different engine than advertised... then I have legal standing to back out.
Twitter has lied to the SEC and every shareholder for years. This is supposed to be information that is accurate, and lying about it is illegal. It's reasonable to assume this information should be true, it isn't, they lied, they need to eat it.
