Safety regulations for E/E systems (which includes electrical and software components) in automotive are done via "self-certification" and adjudicated via post-facto liability suits. There's no FAA or FDA like regulator for automotive currently. As such, I'm not sure who would/could step in and regulate Tesla currently.

Regulators frequently forbid the use or sale of things based on anecdotes while they gather data. And, what data exists?
