No; the reason the Bill of Rights has procedural controls on federal criminal prosecutions (which were later applied to state prosecutions by way of the 14th Amendment and incorporation doctrine) is because criminal prosecution was always one of the tools designed to be used by the federal government in executing authority within its assigned domains of responsibility, which always included (among others) regulating trade among the states and between the US and foreign nations.
There has still been no actual mea culpa or apologies to the families he has destroyed with this and other draconian prohibitionist policies.
