Even as a tech person critical of Google, this seems a bit of an overshoot - you can't stop a website from seeing a request from such and such IP, and it's pretty clear (to me anyway) that Incognito just resets your cookies / local storage / etc. beforehand and doesn't save history.
If in fact Incognito is sending our non-incognito google identity cookies that's a different story, but don't think that's the case here.
It isn't immediately clear what the method of tracking in question is. Device fingerprinting could be another concern.

A federal judge saying that a tech titan must be held accountable for what they claim to do and dont do. Will this particular suit alone change much? Doubt it. Will this suit lay the foundation of precedence to properly wrangle in and hog tie big tech in the near future? Yup. It's a vital decision that shouldn't be over looked.
