Whether there was a legal process defined or not, if it's ambiguous enough to have been determined to be illegal, this should not be handled as glorified breach of contract, and actually handled as what it would actually be if anyone else did it; theft, with conspiracy or fraud charges depending on how much digging the repo providers performed before rolling out and whether it can reasonably be said to pass muster.
